4. Nature of the Service

 

 

Gener8ted Art operates an online platform for the curation, licensing, production and sale of visual artworks applied to physical products.

 

We work with independent artists, galleries, museums, heritage collections, brands and other partners (collectively, “Creators and Custodians”) and with third-party manufacturing and fulfilment partners (“Print Providers”) to produce products on a print-on-demand basis.

 

Unless expressly stated otherwise, Gener8ted Art is not acting as an auction house, investment advisor or financial intermediary. Products are sold as decorative and expressive items only.

 

 

 

5. Accounts

 

 

Some features of the Service may require you to create an account.

 

You agree to:

 

• provide accurate, current and complete information;

• keep your account credentials secure; and

• notify us promptly of any unauthorised use of your account.

 

 

We reserve the right to suspend or terminate accounts that breach these Terms or applicable law.

 

 

 

6. Products and Orders

 

 

 

6.1 Product Information

 

 

We make reasonable efforts to display products and artwork accurately. However, colours, scale and appearance may vary depending on your device and the print process.

 

 

6.2 Order Acceptance

 

 

All orders are subject to acceptance by us. An order is only accepted once you receive an order confirmation email.

 

We reserve the right to refuse or cancel orders at our discretion, including where there are errors in pricing or product information.

 

 

 

7. Pricing and Payment

 

 

Prices are displayed on the Site in the applicable currency and may change without notice.

 

All payments are processed through third-party payment providers. By placing an order, you authorise us and our payment processors to charge the full amount shown at checkout, including taxes and shipping where applicable.

 

 

 

8. Print-on-Demand Production

 

 

All products are made to order specifically for you once an order is placed.

 

As a result:

 

• products are not held in stock;

• production begins shortly after checkout; and

• minor variations in colour, alignment or finish may occur.

 

 

Such variations are inherent to print-on-demand manufacturing and do not constitute defects.

 

 

 

9. Shipping

 

 

Shipping methods, production times and estimated delivery times vary by product and destination and are described in our Shipping Policy.

 

Delivery dates are estimates only and are not guaranteed.

 

 

 

10. Refunds, Returns and Cancellations

 

 

Due to the made-to-order nature of our products:

 

All sales are final. We do not accept returns, exchanges or cancellations once an order has been placed.

 

This includes cases of:

 

• incorrect size or variant selection;

• change of mind;

• colour or appearance differences due to screen settings;

• delivery delays outside our control.

 

 

 

10.1 Damaged or Incorrect Items

 

 

If a product arrives damaged or incorrect, you must contact us within 72 hours of delivery at legal@gener8ted.art, providing:

 

• your order number;

• clear photographs of the issue; and

• a brief description of the problem.

 

 

If the issue is verified, we may offer a replacement or store credit at our discretion.

11. Intellectual Property

 

 

All content on the Site, including artworks, images, designs, text, graphics and software, is protected by intellectual property laws.

 

Creators and Custodians retain ownership of their underlying artworks. By purchasing a product, you acquire ownership of the physical item only.

 

You do not acquire any rights to:

 

• reproduce or distribute the artwork;

• use the artwork for commercial purposes;

• mint, tokenise or otherwise exploit the artwork digitally; or

• create derivative works.

 

 

Any unauthorised use is strictly prohibited.

 

 

 

12. Trust, Provenance and Digital Features

 

 

Some products may include identifiers, codes or features intended to support authenticity, provenance or digital experiences (including AR or scan-based features).

 

These features:

 

• are provided for informational or experiential purposes only;

• do not constitute certificates of ownership beyond the physical product; and

• do not represent financial instruments or investment products.

13. User Content

 

 

If you submit reviews, comments or other content, you grant Gener8ted Art a non-exclusive, royalty-free, worldwide licence to use, reproduce and display such content in connection with the Service.

 

You are responsible for ensuring your content is lawful and does not infringe the rights of others.

 

 

 

14. Prohibited Uses

 

 

You must not use the Site or Service to:

 

• violate any laws or regulations;

• infringe intellectual property rights;

• submit false or misleading information;

• distribute malicious code;

• interfere with the security or functionality of the Site; or

• engage in abusive, harassing or harmful behaviour.

 

 

 

 

15. Third-Party Services

 

 

We rely on third-party providers for payment processing, manufacturing, fulfilment, analytics and other services.

 

We are not responsible for the acts or omissions of third-party providers, which are subject to their own terms and policies.

 

 

 

16. Disclaimer of Warranties

 

 

The Service and all products are provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

 

We do not guarantee that the Service will be uninterrupted, error-free or secure.

 

 

 

17. Limitation of Liability

 

 

To the maximum extent permitted by law, Gener8ted Art Ltd shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or products.

 

Our total liability to you for any claim shall not exceed the amount paid by you for the relevant product.

 

 

 

18. Indemnification

 

 

You agree to indemnify and hold harmless Gener8ted Art Ltd from any claims arising out of your breach of these Terms or misuse of the Service.

 

 

 

19. Severability

 

 

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

 

 

 

20. Termination

 

 

We may suspend or terminate your access to the Service at any time if you breach these Terms.

 

Provisions which by their nature should survive termination shall do so.

 

 

 

21. Governing Law

 

 

These Terms are governed by and construed in accordance with the laws of England and Wales.

 

 

 

22. Changes to These Terms
