Gener8ted Art Trust & Provenance Statement

1. Purpose of This Statement
This Trust & Provenance Statement explains how Gener8ted Art approaches authenticity, attribution, provenance, rights management, and transparency in relation to artworks, products, and associated digital features offered through our platform.
It is intended to provide clarity to customers, creators, custodians, and rights holders regarding what our provenance-, royalty-, and enforcement-related features do—and what they do not do.
This statement should be read together with our Terms & Conditions, Privacy Policy, and other legal notices available on the Site.

3. Artwork Ownership and Rights
All artworks displayed on the Gener8ted Art platform are contributed by, or licensed from, independent artists, galleries, museums, heritage collections, brands, or other authorised partners (collectively, “Creators and Custodians”).
Creators and Custodians retain ownership of the underlying intellectual property in their artworks, subject to the licences granted to Gener8ted Art for the purposes of display, production, marketing, and sale of products.
Purchase of a physical product from Gener8ted Art does not transfer ownership of the underlying artwork or any associated intellectual property rights beyond ownership of the physical item itself.
4. Design Identifiers and Provenance Technologies
Certain products may include identifiers or markers intended to support authenticity, attribution, and provenance. These provenance technologies may include, without limitation:

unique internal design references or identifiers (such as DesignID™);
-
printed or embedded codes (including QR or similar technologies);
-
visible or invisible watermarks;
-
cryptographic manifests linking a physical product to its originating artwork, collection, or authorised edition;
-
immutable cryptographic ledger records used to record provenance-related events, identifiers, or relationships; and
-
internal platform records associated with an artwork, product, or collection.
These technologies are designed to:
-
link a physical product to its originating artwork and rights holders;
-
support transparency around origin, attribution, and authorised production;
-
enable optional digital, interactive, or augmented-reality experiences; and
-
support auditable records relating to authenticity and rights management.
The specific technologies used may evolve over time and may rely on a combination of internal systems and third-party infrastructure.
5. Automatic Royalty Accrual and Independent Settlement
Gener8ted Art operates a system designed to support automatic, transparent, and rules-based royalty accrual for Creators and Custodians.
Where applicable:
-
Each qualifying purchase of a product results in the automatic calculation and accrual of royalties attributable to the relevant artwork and rights holders.
-
Certain digital engagement events (such as verified activations, scans, or platform interactions) may, where expressly stated, also give rise to royalty accrual or accounting entries.
Royalty calculation, accounting, and settlement are designed to operate through an independent third-party settlement and accounting mechanism, separate from Gener8ted Art’s operational accounts.
This structure is intended to:

ensure transparent and auditable royalty records;
-
support fair and ethical compensation of Creators and Custodians; and
-
reduce conflicts of interest between platform operations and rights settlement.
Specific royalty rates, eligibility criteria, payout schedules, and qualifying events are governed by separate commercial agreements with Creators and Custodians and are not publicly disclosed.
6. No Financial, Investment, or Fiduciary Representation
Nothing in this Trust & Provenance Statement:
-
constitutes or implies a securities offering, investment product, or financial instrument;
-
creates a fiduciary, custodial, escrow, or trustee relationship between customers, Creators, Custodians, Gener8ted Art, or any third-party settlement provider;
-
guarantees any level of income, engagement, or payout; or
-
represents that digital engagement events will necessarily result in royalty accrual unless expressly stated.
Products are sold as decorative, expressive, or cultural items only.
7. Digital and Interactive Experiences
Some products may unlock or be associated with digital, interactive, or augmented-reality experiences.
These experiences are:
-
optional and supplementary to the physical product;
-
dependent on device compatibility, connectivity, and third-party technologies; and
-
subject to modification, suspension, or discontinuation at any time.
Participation in digital experiences does not confer ownership rights in the underlying artwork, platform, or any associated systems.
8. Authenticity and Operational Limitations
While Gener8ted Art takes reasonable steps to ensure accurate attribution and provenance, we:
-
rely on information provided by Creators, Custodians, and partners;
-
use third-party manufacturing, logistics, and technology providers; and
-
cannot guarantee absolute accuracy in every circumstance.
Minor variations in production or appearance are inherent to print-on-demand manufacturing and do not affect the authenticity of the underlying artwork.
9. Third-Party Systems, Ledgers, and Technical Limitations
Provenance, engagement, and royalty-related features may rely on third-party systems or infrastructure, including:
-
cryptographic ledgers;
-
distributed or immutable record-keeping technologies;
-
external databases or registries; and
-
third-party manufacturing, logistics, or technology providers.
While cryptographic and immutable systems are designed to resist alteration, no technical system is entirely immune to failure, error, obsolescence, or external dependency.
Accordingly:
-
Gener8ted Art does not warrant uninterrupted availability or perpetual accessibility of any specific ledger, manifest, or technology;
-
provenance records are provided for transparency and informational purposes only; and
-
the existence of a ledger entry or cryptographic manifest does not, by itself, confer legal title, ownership rights beyond the physical product, or financial value.
10. Transparency and Good Faith
Gener8ted Art is committed to operating transparently and in good faith with respect to:
-
attribution of artworks;
-
provenance and authenticity features; and
-
ethical treatment and compensation of Creators and Custodians.
Questions or requests for clarification are welcome.
11. Takedown and Rights Claims Policy
Gener8ted Art relies on representations from Creators and Custodians that submitted artworks are appropriately rights-cleared for the scope of use enabled by our platform and services. However, in rare cases, an artwork presented to us as rights-cleared may later be alleged to infringe the rights of a third party or to cause unintended harm beyond artistic or ethical fair use.
If you believe that an artwork displayed on our platform infringes your rights or otherwise causes such harm, please notify us in writing at legal@gener8ted.art, providing sufficient information to allow us to assess the claim.
Upon receipt of a substantiated written notice:
-
we will remove (“take down”) the contested artwork from our online gallery within 24 hours, while we engage in good-faith dialogue with the notifying party to better understand the alleged infringement or harm; and
-
the artwork will remain unavailable pending investigation.
If our investigation concludes that the artwork does not infringe rights or cause unintended harm, we may decide to reactivate the artwork on the platform.
Royalty Suspension and Reallocation
All artworks published on the platform result in royalty accruals as described above. Where a claim alleges that the registered Creator or Custodian is not the legal and rightful beneficiary of such royalties:
-
automatic royalty settlement for the contested artwork will be suspended within 24 hours of receiving written notice of the claim;
-
royalty accrual records will be preserved, but payouts will be paused pending a full investigation.
If an investigation results in a change of the rightful royalty beneficiary:
-
Gener8ted Art cannot be held liable for royalty payouts made prior to receipt of the written claim; and
-
we will ensure that royalty settlement proceeds to the correct legal beneficiary on a forward-looking basis in accordance with updated records and agreements.
12. Updates to This Statement
We may update this Trust & Provenance Statement from time to time to reflect changes to our platform, technology, settlement arrangements, or enforcement practices.
Any updates will be posted on this page with a revised “Last updated” date.
